Who Should Consider a Temporary Resident Permit (TRP)?
A Temporary Resident Permit (TRP) is a special permit issued to individuals who are otherwise inadmissible to Canada but have valid reasons for needing temporary entry. TRPs are often sought by individuals with prior criminal records, medical inadmissibility, or other issues that could prevent their entry under standard visa conditions. We assist clients in demonstrating compelling reasons for entry, whether for work, family reunification, humanitarian concerns, or other unique situations that warrant consideration.
Purpose and Benefits of a TRP
The TRP was introduced under Section 24 of the Immigration and Refugee Protection Act (IRPA) to offer flexibility in situations where the strict application of immigration laws could cause undue hardship. It permits Canadian immigration officials to allow individuals entry on compassionate, social, or economic grounds, despite inadmissibility. TRPs provide an opportunity for individuals facing exceptional situations to visit Canada temporarily for reasons such as medical treatment, attending significant family events, or fulfilling professional responsibilities.
Eligibility and Application Considerations
To qualify for a TRP, applicants must meet specific criteria, demonstrating that their reason for entry justifies their admissibility. The TRP application includes a “needs versus risk” assessment, which balances the applicant's purpose for entering Canada with any potential risks. Factors considered include:
- The necessity of the individual’s presence in Canada (family connections, job qualifications, event attendance, etc.).
- The purpose behind their entry request, ensuring alignment with the IRPA’s public health, safety, and economic objectives.
- The applicant’s family background, economic contributions, and relationship with Canadian citizens or residents.
Where to Apply and Duration of TRP
TRPs can be applied for at ports of entry or inland offices in Canada. Initial permits can be issued for up to three years, with potential extensions available based on individual cases. Applications are typically submitted in writing, with a comprehensive risk assessment and justification for entry or continued stay. It’s important to note that a TRP is generally canceled if the holder leaves Canada unless explicitly authorized for re-entry.
Is an Interview Required?
Interviews for TRP applications are typically required if the applicant’s inadmissibility involves serious criminality, significant medical issues, or credibility concerns. In cases of minor issues or when the reason for inadmissibility is clear and minor, an interview may not be necessary. However, any flagrant or intentional violations may prompt a more thorough assessment and interview.
